Profitslift Platform – Key Terms of Service

1. Legal Jurisdiction

Profitslift is operated from Vancouver, British Columbia, Canada. By using the platform, you agree that:

  • The Terms of Service are governed by the laws of British Columbia and the federal laws of Canada applicable therein.
  • Any dispute will be brought exclusively in the courts located in Vancouver, British Columbia, Canada.
  • You are responsible for complying with all local laws applicable to your use of the platform.

2. User Consent & Data Usage

By creating an account or accessing Profitslift, you consent to:

  • Collection and processing of account, usage, and configuration data necessary to operate, secure, and improve the service.
  • Use of your data to provide core SaaS functionality (e.g., hosting, backups, performance monitoring, support).
  • Use of aggregated and anonymized data for analytics, benchmarking, and product improvement, without identifying you or your end users.
  • Sharing data with vetted sub‑processors (e.g., cloud infrastructure, analytics, support tools) under contractual data protection obligations.

Customer data is handled in accordance with our Privacy Policy and applicable Canadian privacy laws. You remain responsible for any personal data you upload to the platform and for providing any required notices or consents to your end users.

3. Intellectual Property

  • VancouverCloud and all related software, features, and documentation are owned by us or our licensors and are protected by copyright and other intellectual property laws.

  • You receive a limited, non‑exclusive, non‑transferable, revocable license to access and use the platform for your internal business purposes, subject to the Terms of Service.

  • You retain all rights to content and data you upload to the platform. You grant Profitslift a worldwide, royalty‑free license to host, process, display, and transmit your content only as necessary to provide the service.

  • You may not copy, modify, reverse engineer, resell, or create derivative works of the platform except where permitted by law.

4. Limitations of Liability

  • The platform is provided on an "as is" and "as available" basis, and we disclaim all warranties to the fullest extent permitted by law.

  • To the maximum extent permitted by law, Profitslift will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or business opportunities.

  • Our total aggregate liability for any claims arising out of or relating to the service is limited to the fees you paid for the service in the 12 months preceding the event giving rise to the claim.

  • Nothing in the Terms of Service limits liability that cannot be excluded under applicable law (such as certain statutory consumer protections).
